These Terms & Conditions govern the use of the website saya-sleep.com and the early-access waitlist. Separate terms will apply to the future SAYA app and will be published when it becomes available.

§ 1 Scope

These terms apply to all visitors and users of this website and to all participants of the waitlist and early-access program, in the version in force at the time of use.

§ 2 Waitlist and early access

Free and non-binding

Joining the waitlist is free of charge and non-binding. There is no entitlement to access to the SAYA app, to specific features, or to a specific launch date.

Emails to the waitlist

Registered participants receive the early-access invitation and occasional updates on the product's development. Details of the data processing are set out in the Privacy Policy.

Unsubscribing

You may leave the waitlist at any time without giving reasons — by emailing l.broell@freenet.de or via the unsubscribe link included in every email we send.

§ 3 Availability and changes

No guarantee of uninterrupted availability

We endeavour to keep this website available at all times; however, there is no entitlement to uninterrupted availability. Maintenance, security updates or technical faults may lead to temporary downtime.

Changes to the website

We reserve the right to change, supplement or discontinue the content, design and features of this website at any time.

§ 4 Liability

Unlimited liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act.

Limited liability

In cases of slight negligence, we are only liable for the breach of essential contractual obligations (obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance the user may regularly rely). In such cases, liability is limited to the foreseeable damage typical for this type of contract.

§ 5 Final provisions

Applicable law

The law of the Federal Republic of Germany applies. For consumers, this choice of law applies only to the extent that it does not deprive them of the protection of mandatory provisions of the law of their country of habitual residence.

Jurisdiction

If the user is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from or in connection with these terms is Kempten (Allgäu), Germany. For consumers, the statutory places of jurisdiction apply.

Severability

Should any provision of these terms be or become wholly or partially invalid or unenforceable, the validity of the remaining provisions remains unaffected.
